If you do not agree with any part of these Terms, please do not use our services. We reserve the right to refuse service to anyone for any lawful reason.

2. Definitions

  • "We," "Us," "Our," "dusskweellss": Refers to dusskweellss, a property rental curation service operating in Kuala Lumpur, Malaysia
  • "You," "Client," "Tenant": Refers to individuals or entities engaging with our services
  • "Services": Property curation, viewing facilitation, lease arrangement, documentation provision, and related support services
  • "Property": Residential real estate included in our curated collections
  • "Property Owner": Legal owner or authorized representative of properties in our portfolio
  • "Agreement": These Terms plus any specific lease or service agreements you enter into

3. Service Description

dusskweellss provides property rental curation and facilitation services, including:

  • Property selection and curation based on architectural merit and cultural significance
  • Comprehensive property documentation including condition reports and cultural briefings
  • Viewing coordination and property information provision
  • Lease arrangement facilitation between tenants and property owners
  • Settling-in support and ongoing assistance during tenancy
  • For distinguished residencies: estate stewardship and household coordination

We act as facilitators and curators, not as property owners or direct landlords. Final lease agreements are between you and the property owner.

4. Eligibility and Capacity

To use our services, you must:

  • Be at least 18 years of age
  • Have legal capacity to enter into binding agreements under Malaysian law
  • Provide accurate and complete information during registration and tenancy application
  • Comply with all applicable laws and regulations

5. Client Responsibilities

As a client of our services, you agree to:

  • Provide accurate, current, and complete information during all interactions
  • Attend scheduled viewings punctually or provide adequate notice of cancellation
  • Conduct yourself professionally during property viewings and interactions with property owners
  • Review all provided documentation thoroughly before making decisions
  • Fulfill all obligations outlined in lease agreements you enter into
  • Notify us promptly of any changes to your contact information or circumstances
  • Respect the privacy and property rights of current occupants during viewings

Failure to meet these responsibilities may result in termination of our service relationship.

6. Lease Arrangements

Our role in lease arrangements is limited to facilitation and coordination. We:

  • Coordinate communication between prospective tenants and property owners
  • Provide documentation to support informed decision-making
  • Facilitate lease structuring based on client needs and property owner requirements
  • Assist with administrative processes related to lease execution

We do not:

  • Guarantee lease approval or property availability
  • Assume liability for disputes between tenants and property owners
  • Act as legal representatives for either party
  • Make binding commitments on behalf of property owners

7. Fees and Payment

Service fees are determined based on property type and service level:

  • Heritage District Studios and Lakeview Terrace Homes include standard curation and facilitation services in the monthly rental rate
  • Residencies of Distinction include comprehensive estate stewardship in the monthly rate
  • All fees are quoted in Malaysian Ringgit (RM)

Payment terms:

  • Monthly rental payments are made directly to property owners as specified in lease agreements
  • Initial deposits and advance payments follow terms outlined in individual lease agreements
  • Late payment may result in penalties as specified in your lease agreement

8. Property Information and Accuracy

We make reasonable efforts to ensure accuracy in property descriptions, condition reports, and cultural briefings. However:

  • Property information is provided in good faith based on available data and professional assessment
  • We recommend conducting your own inspection and due diligence before committing to any lease
  • Property conditions may change between documentation and lease commencement
  • Cultural and historical information is provided for context and may contain subjective interpretations

9. Intellectual Property

All content on our website and in our documentation, including:

  • Text, images, graphics, logos, and design elements
  • Property descriptions and cultural briefings
  • Assessment methodologies and documentation templates
  • Website functionality and user interface

Are protected by copyright and other intellectual property rights owned by dusskweellss or our licensors. You may not:

  • Reproduce, distribute, or publicly display our content without written permission
  • Use our content for commercial purposes
  • Modify or create derivative works from our materials
  • Remove copyright notices or proprietary designations

10. Disclaimers

Our services are provided "as is" without warranties of any kind, either express or implied. Specifically:

  • We do not guarantee specific outcomes, property availability, or lease approval
  • We make no warranties regarding property condition beyond what is documented in our reports
  • We do not provide legal, financial, or investment advice
  • Cultural briefings and historical information are provided for educational purposes and may contain interpretations

This is a service facilitating property rentals, not a guarantee of housing or specific residential outcomes.

11. Limitation of Liability

To the maximum extent permitted by Malaysian law:

  • Our liability for any claims arising from our services is limited to the fees paid for those services
  • We are not liable for indirect, consequential, special, or punitive damages
  • We are not responsible for disputes between tenants and property owners
  • We are not liable for property conditions, maintenance issues, or owner actions after lease commencement

Nothing in these Terms limits liability for fraud, gross negligence, or death/personal injury caused by our negligence.

12. Indemnification

You agree to indemnify and hold harmless dusskweellss, its employees, and partners from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or violation of any rights of third parties.

13. Termination

Either party may terminate the service relationship:

  • For convenience with reasonable notice before lease commencement
  • Immediately if the other party breaches these Terms materially
  • As specified in individual service or lease agreements

Termination of our facilitation services does not affect valid lease agreements already executed between you and property owners.

14. Dispute Resolution

In the event of disputes:

  • We encourage informal resolution through direct communication with our team
  • If informal resolution fails, disputes shall be resolved through mediation in Kuala Lumpur
  • If mediation is unsuccessful, disputes shall be subject to the exclusive jurisdiction of Malaysian courts

These Terms are governed by the laws of Malaysia, without regard to conflict of law principles.

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and any specific lease or service agreements, constitute the entire agreement between you and dusskweellss regarding our services.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment

You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.

Notices

All notices under these Terms shall be in writing and delivered to the contact information provided during service engagement or to [email protected].

16. Changes to Terms

We may update these Terms periodically. Material changes will be communicated via email or prominent notice on our website. Your continued use of our services after changes become effective constitutes acceptance of the updated Terms.
